You have an idea for an invention that will revolutionize the world. Nothing too fleshed out yet. You write it on a napkin to return to it later. Some time goes by. You can’t get that invention idea out of your head. You put some work into it. Perhaps you build a prototype. Maybe you have some drawings done up. Now what? Get a patent agent on the job!

My name is Neil Thompson, and I’m a patent agent. What does that mean? I draft and file patent applications for inventors with the United States Patent and Trademark Office (USPTO). I also prosecute patent applications on behalf of inventors with the USPTO.

Conduct a prior
art search

While you may think that no one has ever conceived of your invention, you may be wrong. A prior art search will unearth related invention ideas. Based on the findings of the prior art search, a patent agent will give you an opinion as to whether your invention has already been patented.

Write and file a
patent application

Once an inventor provides the patent agent with the particulars about the invention, a patent agent can write the patent application and submit it to the USPTO.

Prosecute the
patent application

Unfortunately, most patent examiners will reject a patent application initially. A patent agent will communicate with the patent examiner to persuade him or her that the invention should be granted a patent.

That’s it. Well, the process may sound simple, but there’s a lot of lag time. The time between filing a patent application and getting a patent can take awhile – on the order of years.

But don’t fret, a patent agent will keep you abreast of what’s happening every step of the way – at least I will!

But wait…there’s more!

I’m also a writer. After spending almost the last decade as a product development engineer in the medical device industry, I’ve written a lot of documents. Clinical, regulatory affairs, quality, marketing, R&D (of course) – I’ve seen them all. Oftentimes, company employees are swamped. Wouldn’t it be nice to pass along some of those writing projects to someone else?
